Q 2: What will be the duration for drug rehabilitation under observation and compulsory action for drug rehabilitation?
Answer:
I Drug rehabilitation under observation will last for no more than two months. Compulsory action for drug rehabilitation will last for more than six months until compulsory action for rehabilitation is no longer necessary. The entire period will be no longer than one year.
II Drug rehabilitation centers should pay attention to the inmates for rehabilitation under observation. If the addict is determined as no longer inclined towards drug use by a physician, report to the administering prosecutor or the juvenile court (tribunal) for permission of discontinuation of drug rehabilitation no later than 15 days prior to the conclusion of the term for observation and drug rehabilitation treatment.
III If a drug addict has received rehabilitation treatment for six months, and passed the evaluation of discontinuation of further rehabilitation treatment under the “Statue for Rehabilitation Treatment” that no further compulsory action on drug rehabilitation treatment is necessary, the facility can present relevant evidence and report to the administering prosecutor or court to make a judgement on discontinuation of rehabilitation treatment and proceed to discharge.
IV Next of kin are not permitted to petition the prosecutor for discontinuation of drug rehabilitation treatment under observation or compulsory action for drug rehabilitation.
