Justice Instructions to Visits Paid by Attorney-at-Law/Advocate

  1. Application:
  • Application filed on-site: Please carry the required documents and information with you to file the application with the House’s Discipline Section, from 9:00AM to 11:00AM and from 2:00PM to 4:00PM on any working day.
  • Booking via phone:
  1. Please submit the application form for visit paid by the attorney-at-law via fax (Fax No.: 06-2143181, back office of Discipline Section at 06-2150583, Ext. 33) by 5:00PM on the working day prior to the booking date of visit, and verify the House’s acceptance via phone later. Please also carry the application form for visit paid by the attorney-at-law with you to complete the registration at the Discipline Section. Then you may enter the Drug and Alcohol Rehabilitation Room to apply for the visit paid by the attorney-at-law. This may help shorten the time spent in waiting for visiting the juvenile inmate.
  2. You may ask the back office of our Discipline Section for the application form for visit paid by the attorney-at-law or download the form from our website directly. (https://www.tnj.moj.gov.tw/362745/362766/946834/946841/post)
  3. Required documents:
  • Advocate: Required to submit the attorney-at-law license and power of attorney for criminal actions (the power of attorney is required only for the first-time visit); in the case of any personnel other than attorney-at-law appointed under the Code of Criminal Procedure, please present the adequate identification certificates and power of attorney.
  • Attorney-at-Law (Attorney): Required to submit the attorney-at-law license and power of attorney for civil actions/administrative cases (the power of attorney is required only for the first-time visit); in the case of any personnel other than attorney-at-law appointed under the regulations governing legal actions, please present the adequate identification certificates and power of attorney.
  • Attorney-at-law negotiating for the appointment: Required to submit the attorney-at-law license, and related documents showing the negotiation for appointment, e.g. any power of attorney to be executed or case notice received by any attorney-at-law of the Legal Aid Foundation.
  • Legal intern: The legal intern shall present his/her identification documents when paying the visit together with any attorney-at-law or advocate.
  • Any attorney-at-law other than the advocate shall present his/her attorney-at-law license and related power of attorney when applying for visiting any defendant detained and held incommunicado, so that the House may fax said documents to the jurisdictional court/prosecutors office for its approval. Meanwhile, any attorney-at-law other than the advocate may also file the application with said jurisdictional court/prosecutor office directly, and then submit the approval certificate issued by the jurisdictional court/prosecutor office to the competent authority for inspection when conducting the visit.

  1. Directions:
  • Food or any other necessities that are irrelevant to the legal action should be sent via the channel applicable to the general delivery of necessities, and prohibited from being brought by the attorney-at-law or advocate at the time of visit.
  • No communication equipment or video or voice recorder is allowed at the time of visit.
  • No violation of the legal ethics is allowed.
