Applications for General Visits, Increase in Number of Visits , and Flexible Adjustment on Visit

  1. General visits:
  • Definition: The visit which is processed subject to the principles about visitors and frequency defined under the Statute on the Establishment of Juvenile Detention Houses.
  • Application procedure: The applicant files the application with the House’s Reception Room directly.
  • Review standards and procedures: The visit may be scheduled after the House holds that it satisfies the principles about visitors and frequency defined by related laws and regulations.
  1. Increase in the number of visits permitted:
  • Definition: It refers to the incentive for an increase in the number of visits permitted granted by the House pursuant to related laws and regulations, or the House’s approval for additional visits or relaxing of the visitor’s qualifications pursuant to related laws and regulations, if the House deems it necessary in any of the following circumstances:
  1. To facilitate the applicant who lives far away from the House, or is old or young.
  2. The juvenile inmate needs to communicate with the applicant with cause, improve his/her adaption to life in prison, and strengthen family support.
  3. To stabilize the applicant’s or juvenile inmate’s emotion.
  4. The juvenile inmate’s close relative or family member is deceased, or the life and health of such relative or family is in critical condition.
  5. The juvenile inmate performs well in prison, and keeps his/her good deeds due to encouragement.
  6. There is any specific fact substantiating the need to increase the visits permitted.
  • Application procedure: The applicant or juvenile inmate completes the application form for increase in the number of visits permitted and specifies the causes, and then submits the application form to the service center designated by the House.
  • Review standards and procedures:
  1. The visit may be arranged after the application is held satisfying the application requirements by the Director or authorized representative and the reasons of approval are specified. If necessary, the Director or representative may ask the applicant or third person to provide related documents and supplemental explanation, or conduct investigation ex officio voluntarily, if necessary.
  2. Where the Director or representative selects “There is any specific fact substantiating the need to increase the visits permitted,” he/she shall attach related documents or supplemental explanation.
  • Flexible adjustment on visit:
  • Definition: In any of the following circumstances, and whenever the House deems it necessary, the House relaxes the visitor’s qualifications, adjusts the visiting place, grants overtime, or increases the number of visits permitted or the number of visitors.
  1. Cause of management:
  • The House considers it necessary to adjust the visit for the guarding safety concern.
  • The juvenile inmate is physically or mentally disabled, suffers from diseases or is physically challenged and, therefore, is not available to accept the visit through a reception window in the general visiting place.
  1. Cause of edification and counseling:
  • The House considers it necessary to adjust the visit in order to help the juvenile inmate adapt physically and mentally and stabilize emotion.
  • Assistance is required from the applicant, in order to correct, adjust or change the juvenile inmate’s awareness, behavior or relationship.
  1. Major personal incident involving the juvenile inmate:
  • The juvenile inmate is injured with cause and the applicant may comfort him.
  • The juvenile inmate is involved in the incidents, such as parenting, inheritance of property, guardianship of children or other special reasons, and needs to seek solution through negotiation with the applicant.
  1. Other causes:
  • The juvenile inmate’s close relative or family member is deceased, or the life and health of such relative or family is in critical condition.
  • The juvenile inmate’s family suffers some significant disaster.
  • The juvenile inmate’s close relative or family member living abroad returns to Taiwan for the visit and the relative’s or family members’ schedule is tight.
  • The applicant is physically or mentally disabled, suffers from diseases or is physically challenged and, therefore, is not available to accept the visit through a reception window in the general visiting place.
  • The language translation service is needed for the communication between the juvenile inmate and applicant, or the communication needs to be completed in writing or in any other alternative manner.
  • The juvenile inmate needs legal assistance or counseling service, or is required to seek restorative justice.
  • Application procedure: The applicant or juvenile inmate completes the application form for flexible adjustment on visit and specifies the causes, and then submits the application form to the service center designated by the House.
  • Review standards and procedures: The visit may be arranged after the application is held satisfying the application requirements by the Director and the reasons of approval are specified. If necessary, the Director may ask the applicant or third person to provide related documents and supplemental explanation, or conduct investigation ex officio voluntarily, if necessary.
