Application for Certificate of Being an Inmate in a Detention House and Certificate of Release from the Detention House

Q1: How should a juvenile inmate apply for the Certificate of Being an Inmate in a Detention House?
A:
1. Application requirements: A juvenile inmate may apply for the Certificate of Being an Inmate in a Detention House when dealing with military service procedure, property inheritance, student loans, tuition subsidy, agricultural, labor or health insurance, low income household subsidy, disability subsidy and national pension subsidy, transfer of house or vehicle, divorce agreement, child support, etc.
2. The Certificate of Being an Inmate in a Detention House shall be applied for by the juvenile inmate. If a family member of the juvenile inmate comes to the detention house to apply for the Certificate of Being an Inmate in a Detention House for the juvenile inmate, the family member has to take his/her ID card and sufficient documents to certify the relation between the juvenile inmate and the family member. The Certificate of Being an Inmate in a Detention House will not be issued to the member without the ID card and the required documents.
3. Procedure: The juvenile inmate shall write an application report or fill out the application. Applicable certifying documents shall be attached to the report or application. The juvenile inmate shall file the application with the organization. After the organization has approved the application, the Certificate of Being an Inmate in a Detention House, where the seal of the organization is affixed, will be issued to the applicant. The organization will ask the family member designated by the inmate to pick up the certificate, or give it to the juvenile inmate and then the juvenile inmate can mail it to the family member.

Q2: How should a juvenile inmate apply for a Certificate of Release from the Detention House?
A:
1. Paper application:
(1) A juvenile who was in the detention house may take his/her ID card and personal chop to the organization to apply for a Certificate of Release from the Detention House. If the juvenile inmate authorizes a family member to apply for the certificate for him/her, the family member shall take the power of attorney, the ID card of the juvenile, the ID card of the family member and sufficient documents to certify the kinship between them for the organization to verify.
(2) Relevant documents are available to be downloaded from the Ministry of Justice’s Online Application Service System (https://eservice.moj.gov.tw/mp.asp?mp=275).
2. Online application:
(1) Please download an application form from the Ministry of Justice’s Online Application Service System and fill in every box of the application form (on which the applicant has to affix his or her personal seal). Then the applicant may mail the application form and the photocopies of the front and back sides of the applicant’s ID card to the authority.
(2) After the detention house receives the application form and completes its assessment, the senior officer at the organization will issue the certificate and mail it to the applicant. (Please enclose a self-addressed stamped envelope and write down the address and name of the addressee.)

Q 3: Is the letter of appointment from the juvenile inmate, specimen seal impression card, or proof of appointment necessary? How can I apply?
Answer:
I There are two types of letter of appointments for juvenile inmates for the authorization of handling different subject matters, namely, general authorization and authorization for applying for specimen seal impression.
II For the appointment of general authorization (fingerprint), the next of kin of the juvenile inmate may obtain the standard form of power of attorney or authorization of agent from the competent authority, deliver the document to the juvenile inmate by mail, or deliver it in the care of the mailing room of the General Affairs Section of this facility to the juvenile inmate. They may also fill in a blank standard fingerprint authorization that the juvenile inmate may prepare the report of and attach the power of attorney or authorization of agent to submit the application in due procedure. Upon approval by this facility, the General Affairs Section will affix the fingerprint validation stamp and issue the document. Under this arrangement, the next of kin can make the claim or the juvenile inmate may deliver the items by mail to the next of kin.
III For power of attorney in processing specimen seal related matters, mail the power of attorney to the juvenile inmate or deliver it in the care of the mailing room of the General Affairs Section of this facility to the juvenile inmate. The juvenile inmate will then prepare a report and submit the application with the power of attorney for approval. Once approved, the General Affairs Section will write to the household registration authorities with notification to the agent. On receiving the document, the household registration authorities will contact the agent for further action.
IV If the next of kin of the juvenile inmate pick up the related power of attorney at this facility in person, the national ID card or certification document sufficient for proof of identity and personal seal are required. The person may claim the content specified upon authentication of identity.
